Nassar Seeks Resentencing & Wants Judge Aquilina Disqualified
Lawyers for Larry Nassar are asking for resentencing in Ingham County and they want Judge Aquilina disqualified from the case. They feel her behavior and comments during the case "demonized" their client and led to Nassar being assaulted in prison.
See the 2 motions filed below!
Nassar has been sentenced three times: once in federal court, once in a state court in Ingham County, and lastly in another state court in Eaton County. These motions are only related to the sentencing in Ingham, which also is the one that drew the most attention after more than 150 women all said in court that Nassar had sexually abused them and then went into great detail about how that abuse impacted their lives. During the sentencing, Aquilina would sometimes speak from the bench after a woman had given her statement, and Aquilina spoke again before sentencing Nassar as well. Her comments were some of the most quoted parts of Nassar’s sentencing—and they are key to the requests from Nassar’s lawyers. (Source: Deadspin)
Nassar, who is serving a 60-year federal prison sentence on three child pornography charges and was sentenced to decades more in state prison on 10 sexual assault charges, filed two motions Tuesday in Ingham County Circuit Court.
Nassar told his attorneys that he was attacked in federal prison within a few hours of being placed in the general population, according to the motion. His attorneys attributed that attack, and the attempted attack on Nassar by the father of three of his victims during his Eaton County sentencing, to "Judge (Rosemarie) Aquilina's efforts to demonize Dr. Nassar in front of the entire world."
One of the motions seeks resentencing to correct what Nassar argues is an invalid sentence. The other seeks Judge Aquilina's disqualification and the assignment of a new judge to sentence him. His court-appointed appellate attorneys argued that Aquilina was "admittedly not an unbiased and impartial judge." (Source: Lansing State Journal)
A hearing on the requests is scheduled for Aug. 3. Both motions are in full below:
